Terms of Use
These terms cover your use of the Loam app and loamfit.com. "Loam", "we" and "us" mean the operator of the Loam app. By creating an account or using Loam, you agree to these terms and to our Privacy Policy. If you don't agree, don't use Loam.
1. Not medical advice
Loam gives fitness and wellness information. It is not a medical device, and it does not diagnose, treat or prevent any condition. Scores such as readiness and Capital are estimates.
- Talk to a doctor before you start a new exercise or nutrition plan, especially if you have a health condition, are pregnant, or are coming back from an injury.
- Stop exercising and get help if you feel pain, dizziness, faintness, chest tightness or unusual shortness of breath.
- In an emergency, call your local emergency number.
You are responsible for your own training, diet and safety decisions.
2. AI coaching can be wrong
Some of Loam's content is written by AI. It can be wrong, incomplete or not right for you. Use your own judgment and don't rely on it for medical, nutrition or safety decisions. Nutrition values from meal descriptions and food databases are approximate.
3. Your account
- You must be at least 13 to use Loam, or older where local law requires. If you are under 18, you need permission from a parent or guardian.
- Give accurate information and keep your password to yourself. You are responsible for what happens on your account.
- Tell us right away if you think someone else has access to your account.
4. Beta software
Loam is in beta. Features may change, break or be removed, and data may be incomplete, wrong or lost. We may change or stop any part of Loam at any time.
5. Acceptable use
Don't:
- break the law using Loam
- access or try to access other people's accounts or data
- interfere with or overload the service, probe it for vulnerabilities, or get around limits such as AI usage limits
- scrape Loam or access it with automated tools
- copy, modify or reverse engineer the app, except where the law allows it
- upload content that is unlawful, harassing, hateful or sexual, or that infringes someone else's rights, including in your profile photo, bio or messages
- use AI features to try to produce harmful content
6. Your content
You own the data and content you add to Loam. You give us permission to store, process and display it only as needed to run Loam for you, as described in the Privacy Policy. If you share content with other users, they can see it.
7. Third-party services
Loam works with services run by others, such as Apple Health, WHOOP, and food and weather data providers. Your use of those services is governed by their own terms and privacy policies. We are not responsible for those services, their availability, or the accuracy of the data they provide. Data from devices and services can be missing or wrong.
8. Price
Loam is currently free. If we introduce paid features, we will describe the price and terms before you buy.
9. Our app
Loam's software, design and content, other than your content, belong to us. We give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, for your own non-commercial use, under these terms and the App Store's usage rules.
If you send us feedback or ideas, we may use them without any obligation to you.
10. Ending your use
You can stop using Loam and delete your account at any time in You > Delete account. We may suspend or end your access if you break these terms or to protect Loam or other users. Sections that by their nature should continue after your access ends will continue, including sections 1, 2, 11, 12 and 15.
11. Disclaimers
To the fullest extent the law allows, Loam is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that Loam will be uninterrupted, error free or secure, or that any data will be accurate or kept.
12. Limitation of liability
To the fullest extent the law allows:
- We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of Loam.
- We are not liable for injury or loss that results from exercise, training, nutrition or other decisions you make using information from Loam.
- Our total liability for any claim about Loam is limited to the greater of the amount you paid us for Loam in the 12 months before the claim, or US$50.
Some places don't allow these limits. Nothing in these terms limits liability or consumer rights that cannot be limited under the law that applies to you.
13. Apple
If you got Loam from the App Store:
- These terms are between you and Loam, not Apple. Loam, not Apple, is responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
- Apple is not responsible for any claims about the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that the app infringes someone's intellectual property.
- You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of restricted parties.
- You must follow any third-party terms that apply when you use the app, such as your mobile carrier's.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Changes to these terms
We may update these terms. We will post the new version here with a new effective date, and tell you in the app or by email if a change is significant. If you keep using Loam after a change takes effect, you accept the updated terms.
15. General
If any part of these terms can't be enforced, the rest stays in effect. If we don't enforce a right, we have not waived it. You may not transfer these terms. We may transfer them as part of a merger, sale or reorganization. These terms and the Privacy Policy are the whole agreement between you and us about Loam.
